These Terms of Service (“Terms”) govern your access to and use of the LovitaShorts website and applications (the “Service”), operated by LovitaShorts (“we”, “us”, “our”). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. Our Privacy Policy describes how we handle your information.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You represent that you meet this requirement and that the information you provide is accurate.
2. Accounts
- You may sign in using a supported third‑party identity provider such as Google.
- You are responsible for maintaining the confidentiality of your account and for all activity under it.
- Accounts are personal and non‑transferable. You may not share, sell or lend your account or credentials.
- You must notify us of any unauthorized use of your account.
3. The Service
The Service provides streaming of short‑form video content. Some content is free, some requires a subscription, and some may require unlocking with points or a per‑item purchase. We may add, change or discontinue features and content at any time.
4. Subscriptions, Points and Payments
- Prices are shown at checkout in the currency displayed by the Service.
- Unless stated otherwise, subscriptions are one‑time payments for the selected period and do not auto‑renew.
- Points are a virtual, non‑refundable credit usable only within the Service and have no cash value.
- Payments are processed by third‑party providers; you must comply with their terms.
- Unlocks and entitlements are licensed to you, are personal, and are not transferable.
5. Refunds
Where required by law you may be entitled to a refund. Otherwise, purchases of digital content, subscriptions and points are generally non‑refundable once delivered. Contact us for any billing disputes or issues.
6. Acceptable Use
You agree not to:
- Copy, download, redistribute, publicly display or otherwise exploit content except as permitted.
- Use robots, scrapers or automated means to access the Service without our consent.
- Circumvent, disable or interfere with security, DRM, rate limits or access controls.
- Upload malicious code, or attempt to gain unauthorized access to systems or data.
- Use the Service for any unlawful purpose or in violation of these Terms.
7. Prohibition of Non-Consensual Intimate Imagery (NCII) and Deepfakes
LovitaShorts strictly prohibits any creation, upload, sharing, or distribution of sexually explicit material, non-consensual depictions, or unauthorized digital likenesses. Specifically:
- Strict Prohibition: You may not use our services to generate, upload, or share any Non-Consensual Intimate Imagery (NCII), deepfake adult content, or any sexually explicit materials. Any violation will result in immediate termination of your account.
- Unauthorized Likeness & Deepfakes: You may not use AI tools or any feature of the Service to synthesize, alter, or depict real individuals in sexually suggestive, naked, or intimate contexts without explicit legal consent.
- Safety Moderation & Enforcement: We employ proactive automated content safety filters and human review to identify and block abusive, explicit, or non-consensual materials. Violating content will be immediately taken down, offender accounts permanently terminated, and relevant evidence may be reported to law enforcement.
8. Intellectual Property
All content, software, trademarks and materials in the Service are owned by or licensed to us and are protected by intellectual property laws. You receive a limited, revocable, non‑exclusive, non‑transferable license to access the Service for your personal, non‑commercial use. No rights are granted beyond this license.
9. User Submissions
If you submit content, comments or other materials, you keep ownership but grant us a worldwide, non‑exclusive license to host, display and use them to operate and improve the Service. You are responsible for what you submit and represent that you have the rights to do so.
10. Availability and Changes
We do not guarantee uninterrupted access. Content availability, features and pricing may change, and some content may become unavailable in your region.
11. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate accounts, or restrict access, if you violate these Terms, engage in fraud or abuse, or where required by law. Upon termination your right to use the Service ends.
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a purpose and non‑infringement. We do not warrant that the Service will be error‑free or uninterrupted.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or content. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.
14. Indemnification
You agree to indemnify and hold us harmless from claims, damages and expenses arising from your use of the Service, your content, or your violation of these Terms.
15. Changes to These Terms
We may update these Terms. For material changes we will provide notice where appropriate. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which LovitaShorts operates, excluding conflict‑of‑law rules. Any dispute will be resolved in the competent courts of that jurisdiction, except where consumer law requires otherwise.
